What Arizona's housing laws do here

Arizona's ADU law applies in Scottsdale. The 2020 census population was 241,361, above the 75,000 threshold in A.R.S. § 9-461.18, so the statute binds the city.
A.R.S. § 9-462.13, the middle-housing law, uses the same 75,000 threshold and also binds the city. Scottsdale has adopted its own rules under each. The detail is in the two sections below, carried unchanged from the independently reviewed draft.
What Scottsdale allows on a single-family lot

SCOTTSDALE'S ADU RULES, AS OF SEPTEMBER 30, 2025
Scottsdale has more than 75,000 residents, so Arizona's ADU law applies here. The city adopted Ordinance 4687 on September 30, 2025, and put its ADU rules in Zoning Ordinance Sec. 7.900.
The city allows three kinds of units: an attached ADU, a detached ADU, and a restricted-affordable detached ADU. The first ADU may be up to 1,000 square feet or 75% of the main home, whichever is less. A second or third ADU is capped at 500 square feet. A third detached unit is allowed only on a lot of one acre or more when one unit is affordable.
Scottsdale also requires separately metered electric and gas service, a separate exterior entrance and address, ten feet between structures, and private outdoor space at least five feet deep and 50 square feet. A detached ADU may not be built in a required front or side yard. One built in the rear yard may sit as close as five feet to a side or rear yard line. An attached ADU follows the lot's normal setbacks. No more than six adults may live across all units on the lot. An ADU cannot be sold apart from the main home. The city's page also states: "The property owner must reside on the premise for any ADU that is rented, leased, offered for rent or lease, or occupied as a Vacation Rental or Short-term Rental."
Parts of Scottsdale sit in the operating vicinity of Phoenix Sky Harbor International Airport and Scottsdale Airport, where state law still excludes some land from the ADU mandate. The 2025 amendment (HB 2928) narrowed that area to land above 65 decibels of airport noise.

Middle housing near Old Town

DUPLEXES TO FOURPLEXES, WITHIN A MILE OF OLD TOWN
On November 17, 2025, Scottsdale adopted Ordinance 4690 to meet Arizona's middle-housing law. Single-family lots within one mile of the Old Town Area may now hold duplexes, triplexes, and fourplexes. Middle housing is also allowed as a limited part of a new residential development over ten acres: at least 20% of any new development of more than ten contiguous net acres.
Lots inside the Scottsdale Airport 65 DNL noise zone are excluded. So are lots whose recorded CC&Rs prohibit middle housing. The state law does not override private covenants.
The standards: two stories maximum, a cumulative floor area ratio of 0.5, at least one parking space per unit and none in the front yard, ten feet between buildings, and a separate entrance for each unit. No owner-occupancy or fire-sprinkler requirement.
Why Old Town is the anchor: on September 10, 2024, four days before the state law took effect, the city council adopted Resolution 13232 and repealed its single Central Business District designation. The city's planning report states Old Town serves as the designated downtown, so the one-mile rule runs from the Old Town Area.
