Arizona's ADU law applies in Surprise. The 2020 census population was 143,148, above the 75,000 threshold in A.R.S. § 9-461.18, so the statute binds the city.

A.R.S. § 9-462.13, the middle-housing law, uses the same threshold and also binds Surprise.

Surprise's implementing ordinances and current zoning requirements have not been independently verified. Confirm them with the City before planning.

More than half of Surprise — 51.5% of its area — sits inside the Luke Air Force Base vicinity. On a Surprise parcel that question has to be answered before an ADU or a duplex is designed, not after.

Arizona's ADU statute (A.R.S. § 9-461.18(G)) and middle-housing statute (A.R.S. § 9-462.13(D)(8)) exclude qualifying territory near a military airport as defined in A.R.S. § 28-8461.
